Thought River Terms of Service

These Terms of Service ("Terms") are an agreement between you and Gobitron, LLC ("Gobitron," "we," "us," or "our") governing your use of the Thought River mobile app, website, account features, testing programs, and related services ("Thought River" or the "Service"). By using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old and legally permitted to use the Service. If you are under the age of legal majority where you live, a parent or guardian must review and agree to these Terms on your behalf where required by law. Do not use the Service if applicable law prohibits it.

What Thought River is

Thought River is a private visual practice for noticing a thought, lightly naming it, choosing its current intensity, following a short practice, and returning to the River. Some features work without an account. Account features may provide encrypted continuity, cross-device recovery, private Thought Journey history, and factual Trends or Insights.

We may add, change, limit, or remove features over time. A feature described in these Terms may be available only in a particular build, test, device, account, or region.

Wellness and safety limitations

Thought River is a wellness and thought-flexibility practice. It is not therapy, counseling, treatment, diagnosis, a medical device, medical advice, crisis care, emergency response, or a substitute for a qualified professional. We do not monitor thought labels for risk and cannot contact emergency services on your behalf.

Do not use Thought River for an emergency or rely on it to decide whether a thought, feeling, symptom, or situation is safe. If you may be in danger or need urgent help, contact local emergency services, a crisis resource, or a trusted person who can help now.

A completed practice, release, Trend, Insight, or visual change does not prove that a thought softened, disappeared, improved, was false, or was resolved. Your current intensity and other selections are your own reports, not clinical assessments.

Guest use and accounts

You may use available Guest River features without an account. Device-local Guest data may be lost if you clear it, delete the app, clear app storage, lose the device, or fail to complete an acknowledged account save. We cannot recover Guest data that never reached an account.

An account may require Apple, Google, or verified email and password sign-in. You agree to provide accurate account information, keep your sign-in method secure, and promptly tell us about suspected unauthorized use. You may not impersonate another person, create an account for someone without authority, or transfer your account.

Your content and private History

You keep ownership of thought labels, feedback, and other content you provide. You give Gobitron a limited, non-exclusive, worldwide, royalty-free license to host, encrypt, process, transmit, reproduce, and display that content only as needed to operate, secure, and support the feature you chose, create anonymous information under the boundaries below, and comply with law. This license ends when the content is deleted from active systems, subject to the retention limits in the Privacy Policy.

Do not enter content that is unlawful, infringes another person's rights, contains another person's confidential information without permission, or includes credentials, authentication tokens, or unnecessary medical records. Thought River does not use raw or account-linked thought labels for advertising, diagnosis, automated decisions about you, personalization based on a label's meaning, or general-purpose AI model training. Gobitron may use only anonymous information derived from thought labels, product usage, or user-selected shape characteristics to research, develop, test, and improve Thought River. That information must not be reasonably linkable to an account, device, or person. Gobitron will not attempt to reidentify it or combine it with information that would make it linkable. Raw, encrypted, pseudonymized, or otherwise linkable thought labels are not used for product development. The Privacy Policy explains this boundary and the notice or consent required before a materially different use.

When private Thought Journey is available, deliberately registering a thought creates an owner-scoped historical occurrence. Releasing a thought removes it from the present River but does not delete that private history entry. You can delete an individual entry, clear private History, or delete the account. Deleted labels are destroyed as described in the Privacy Policy, while content-free deletion records may remain temporarily to prevent an offline or older device from restoring them.

License and ownership

Gobitron grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for your own non-commercial use in accordance with these Terms. Gobitron and its licensors own the Service, including its software, designs, visual systems, audio, text, trademarks, and other materials, except for your content.

Except where law allows otherwise, you may not copy, sell, rent, sublicense, distribute, modify, reverse engineer, scrape, extract, or create derivative works from the Service or bypass its access, security, or technical limits. Feedback is voluntary. If you provide product feedback, you allow us to use it without restriction or payment, but we will handle personal information in the feedback under the Privacy Policy.

We may investigate suspected misuse and restrict or suspend access when reasonably necessary to protect users, the Service, or others.

Privacy, notifications, and third-party services

The Privacy Policy explains how we handle information. You control operating-system permissions such as notifications. Turning off a permission may limit the related feature but should not prevent ordinary River use where the permission is not required.

The Service may rely on Apple, Google, authentication, hosting, database, email, analytics, diagnostics, notification, and app-distribution providers. Their services may be subject to separate terms and privacy policies. We are not responsible for a third-party service outside our control, but we remain responsible for selecting and directing our service providers as required by law. Apple or Google may also impose platform terms for your download and use of the app.

Account deletion and termination

You may stop using Thought River at any time. If you have an account, you can delete it through Account and profile. Account deletion is irreversible and removes account-owned River content as described in the Privacy Policy. An offline device may retain an inaccessible local cache until it reconnects or the app clears it.

We may suspend or terminate access if you materially violate these Terms, use the Service in a way that creates legal or security risk, or if we discontinue the Service. Where reasonable, we will provide notice and an opportunity to export or delete account data unless doing so would create risk or violate law. Sections that by their nature should survive termination, including ownership, warranty disclaimers, liability limits, and dispute-related terms, will survive.

Service changes and availability

Thought River depends on devices, operating systems, networks, authentication providers, hosted services, and managed backups. We do not promise uninterrupted availability, a particular recovery time, permanent support for a device or operating-system version, or recovery of data that the server did not acknowledge. We may perform maintenance or change the Service. We will not use a rollback to intentionally restore content you deleted.

Disclaimers

To the fullest extent allowed by law, the Service is provided "as is" and "as available." Gobitron disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or useful for every person, or that it will change a thought, feeling, behavior, health condition, or outcome.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms limits a right or remedy that cannot legally be limited.

Limitation of liability

To the fullest extent allowed by law, Gobitron and its members, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities, arising from or related to the Service. This limitation applies regardless of the legal theory and even if we were advised that the damage was possible.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits such a limit.

Changes to these Terms

We may update these Terms as the Service or legal requirements change. We will change the Effective Date and provide additional notice in the app, on the website, or by email when a change is material and notice is required. Changes apply prospectively. If the law requires consent to a material change, we will request it. If you do not agree to revised Terms, stop using the Service and delete your account.

General terms

These Terms and the Privacy Policy are the entire agreement between you and Gobitron about the Service unless another written agreement applies. If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of the Service, subject to applicable law.

These Terms do not select a mandatory arbitration process, waive a class-action right, or override non-waivable consumer protections. Applicable law and a court with lawful jurisdiction will govern disputes unless a later agreement validly states otherwise.
